The FCA has published a consultation paper (CP22/14) on broadening access to the long-term asset fund (“LTAF”) by retail investors and defined contribution pension plans. The proposals reflect his desire to see investing in long-term illiquid assets as a feasible option for a wider range of investors with long-term investment horizons who understand risk and can absorb losses. It is an attempt to strike a balance between reducing loss and risk and facilitating more investment opportunities.

What does the consultation say?

The FCA has outlined its proposals that would enable broader access to non-traditional and typically hard-to-reach investments, leading to portfolio diversification and potentially higher returns, while incorporating additional investor protections.

The main proposals include:

• Reclassification the LTAF as a restricted investment in the mass market (“RMMI”) based on the rules set out by the FCA in PS22/10 on strengthening financial promotion rules for high-risk investments. As it stands, the LTAF promotion is restricted to Professional Investors, Certified and Self-Certified Sophisticated Investors and Certified High Net Worth Individuals. Restricted retail investors could invest as long as they undertake suitability assessments to show they understand the risks and redemption terms before being allowed to invest up to 10% of their portfolio in LTAF. In addition, the regulator is proposing that restricted retail investors receive a specific risk warning, including specific references to investment horizon, liquidity and redemptions.
• Increase the exposure quantity funds of alternative investment funds may have in LTAF (up to a maximum of 50% of plan assets in LTAFs and 35% in an LTAF) and the disabling of the enhanced due diligence provisions under the COLL for FAIFs that invest in LTAFs.
• Alignment of some LTAF rules the investor protection rules that apply to other authorized retail funds, including:
  • Full engagement with unitholders regarding any proposed fundamental or material change to the fund.
  • Regular updates for investors should be provided in the event of a suspension of trading.
  • Modalities for holding meetings of unitholders.
  • Restrictions on the types of payments and charges that may be levied on the classes of LTAF units made available to retail clients.
• Removal of the 35% restriction on illiquid assets in unit-linked products, where the investor is an eligible default pension plan. This would give LTAFs a status equivalent to other illiquid assets, which would fulfill the conditions to ensure an appropriate degree of consumer protection.

The regulator notes that there would be no requirement for firms to produce and distribute LTAFs for retail investors, or for investors to only use LTAFs to invest in long-term illiquid assets. He also acknowledges that it may take some time before significant numbers of LTAF are produced and widely marketed.

The FCA also stressed the need for all companies that manufacture, manage or distribute LTAF to retail investors and customers to comply with the new consumer obligation.

A dispute between a Texas church and its faith-based umbrella organization underscores the need for other dispute resolution processes.

The civil court system has no jurisdiction to get involved in a dispute between a local Adventist church and its faith-based umbrella organization, the Second Texas Appellate District in Fort Worth, ruled Thursday.

The Seventh-day Adventist Church of Northwest Fort Worth (“Northwest Church”) filed suit against its regional governing body, the Texas Conference, and the Southwest Union Conference. The circumstances of the dispute are briefly touched upon in the decision and, as in any case of this nature, are undoubtedly much deeper.

Essentially, the local treasurer under a previous church board (the board had since been replaced) whose name still appeared on the account had written a check to the Conference which had depleted local funds. To pay the expenses, the church board then tried to get money from its Union-level savings account, which sent them a check but the Conference put a “stop payment.” ” above. On February 21, 2019, the Conference changed the locks on the building and, according to church members, took the key to their post office box.

ALEXANDRIA, Va.—Jim Ward retired as president and chief executive officer of one of America’s largest motor carriers earlier this year. But he wasn’t ready to retire from the trucking industry, which he says is going through one of its most exciting historic transformations.

Longtime frontman DM Bowman (#256 on the Fleet owner 500: list for hire) had been a member of the Truckload Carriers Association for years before rising through the association’s executive ranks to become president. Now he leads TCA as the new president.

The Maryland native sat down with Fleet owner in his new office at the Truckload Carrier Association headquarters here in Old Town, across the Potomac River from Washington, D.C., where he recently took over as president, replacing John Lyboldt, who took his retirement in April. Since taking over TCA, Ward has been working with his team to plan for its next fiscal year, including seeking ideas from associates on how to improve the group’s many events and educational programs. My first introduction to the trucking industry as a member of the association is said to have been in 1986. FO: As someone who has been on the member side and on the management side of TCA, how can members get the most out of an association?

Hall: As a member on the other side, the nice thing about associations is that you only have one carrier member, you only have one vote. If you don’t benefit by participating and providing that voice of your business to the association to help them frame their advice and direction for their committees, shame on you.

FO: How are you working with the government to improve trucking?

Hall: We have a government affairs branch. We stay in our lane. These are whole truck concerns and issues. Admittedly, we are by no means ATA (American Trucking Associations), and we know it. But we need to have some dry powder in case there are situations specific to our truck-loaded members that we can go to Capitol Hill and talk about them intelligently and represent them well.

We just sent a letter to Secretary of Transportation Buttigieg, Secretary of Labor Walsh, and FMCSA Administrator Hutcheson about our voluntary shipper-carrier-driver relationship guidelines, which we’ve had in place here at TCA since the early 2000s. So we’ve put together some best practices.

FO: What is TCA doing to improve the work of truck drivers?

Hall: Coming out of COVID is an opportunity for us to profess processes and things we can keep working on to do a better job of driving. Workforce development is a challenge for everyone. But this has been a significant challenge in our industry for many years.

Being able to effectively manage the time of a professional driver is essential. It’s critical for motor carriers because you have assets—whether it’s human resources or physical assets—that you need to move. Embedding speed into the system certainly helps address the supply chain challenges we are currently facing. It’s also about the simple things in life, which go back to what we call the golden rule of treating drivers like the professionals they are. Ensure drivers have access to facilities at shipper sites.

We have seen some states come up with legislation mandating the use of restrooms. We say, wait a minute. We don’t know if we need a law to do that. We think it’s just good common sense practice. So let’s work together to make sure we take care of our professional driver employees.

We want to reduce some of the complexity of the supply chain system by working together. There’s no better time to do it than now.

FO: Do you think the industry is moving towards sustainable development?

Hall: I was first challenged by the thought process of electric vehicles, their practicality and their integration into the industry. But as I sit with you today, he’s going to be here a lot quicker than I ever imagined. I think our members would tell you that as well.

There are still many unanswered questions about this. Especially when you’re talking about the power grid and how you’re going to provide the necessary load capacity that will be needed. Also, there are questions about the residual value of the equipment depending on what you will pay upfront.

But we as an industry – and our members – are good stewards of our environment. We understand the importance of this. START OF THE FARNBOROUGH AIRSHOW: The aviation industry descends on Farnborough in Hampshire this week for the first major commercial airshow since Paris in 2019. More than 80,000 visitors are expected to experience the five-day bargain, which will be an opportunity for the sector to demonstrate how he is recovering from a bruised two years during the COVID pandemic.

What to expect? Much of the focus will be on aircraft makers Airbus and Boeing, which will showcase new models in hopes of snagging big orders. The fates of the two companies have been different in recent years: the American manufacturer has experienced difficult times commercially since two fatal crashes of the 737 MAX in 2018 and 2019. In the meantime, Airbus is expected to sell more of its long-fuselage model A321neo, including an order from the German carrier Condor. The pressure is there: Boeing will want a successful show. The manufacturer has fallen behind European rival Airbus, which dominates the order and delivery categories in 2022. WHY DB WILL NOT SELL ITS DATA: German railroad Deutsche Bahn has long been in dispute with private ticket sellers and train operators over its approach to data access. For example, it will not allow platforms to access key information on delays or sell discounted tickets; nor will it allow the sale of seats for alternative operators such as Flixtrain through its own dominant platform, a market leader called bahn.com (bahn literally means “railroads”). This site is effectively state funded, as the DB is state owned, and is a must for most European rail travelers as it has downloaded timetables for all European trains (although in most cases, the DB website cannot actually sell bookings for non-German routes, unless they start in a German city).

This long-running dispute between DB and its challengers is currently being examined by Germany’s Federal Cartel Office (the European Commission is expected to legislate on some of the broader aspects of open data later this year, officials told us). According to our colleague Louis Westendarp, the DB claims that it is simply more efficient to manage its own distribution of tickets; however, the company is on shaky ground here given that the platform is so dominant and open data opened up the aviation market years ago. Many rail watchers expect a rapid period of market liberalization over the next few years. With efficient railways very important to going green, it is believed that it should be easier to book travel between major capitals by train than it actually is. This makes the DB case in Germany a critical test.

Upcoming airlines: Unlike airlines, where many platforms exist that can sell tickets from A to B around the world, travelers often have to go to different national platforms such as bahn.com to find tickets for transcontinental travel. DECOMPOSE BATTERY CASH DUMP? The European Commission is great at announcing big numbers and big plans on things like batteries and hydrogen as part of its state-backed investment programs. However, it is less effective at breaking down where the money is coming from and where everything is going for strategic initiatives. The approval last week of a record €5.4 billion in grants for an Important Project of Common European Interest (IPCEI) on hydrogen technology, Hy2Tech – essentially a multi-grant project States on Steroids – came with details of companies that got public funding from a 2019 IPCEI for batteries, which is pretty big of a deal.

How long? It took two and a half years for this information to come to light, and the document still only provides a range for the taxpayer subsidy each company got. The program aims to provide automakers with local battery cells to use in electric cars, rather than making them dependent on imports, mainly from China.

Who receives the money: Of the 41 projects, 15 are based in France, 10 in Italy and 6 in Germany, French MEP Christophe Grudler said in a statement. Some 2 billion euros out of the 5.4 billion in aid approved by the Commission come from French coffers. France’s northern Franche-Comte region, close to the border with Switzerland, hosts three major projects, Grudler said: €247 million for Alstom, €213 million for Faurecia and €114 million for McPhy.

And the winner is … ? The first beneficiary of PIIEC 2019 was the Automotive Cells Company (ACC), which received between 500 and 1 billion euros in French aid and between 350 and 510 million euros in German aid. Marketing departments in organizations across Ireland are undergoing a fundamental change in the way they use and capture data following changes in the way businesses can use 3^rd party cookies. However, a Compliance Ireland survey of 144 compliance professionals in Irish organizations across the country found that although Google’s impending changes to the use of 3^rd party cookie data will have implications for almost 9 out of 10 businesses there is a general lack of awareness, with 74% of respondents saying there is little or no awareness of the issue within their organization.

The survey also looked at whether or not marketing and compliance teams were working together to prepare and develop new data collection strategies before these changes – more than half said there was no coloring, while an additional 14% said they would like to work more closely with the marketing department.

Michael Kavanagh, CEO of the Compliance Institute (formerly the Association of Compliance Officers in Ireland (ACOI), said the findings highlight a communication problem within Irish organizations that needs attention.

“In 2023, Google Chrome will block third-party cookies and approx. 65% of the global market, this will force marketers to consider other options. However, these results indicate a lack of awareness, a lack of preparation and perhaps a lack of collaboration All of these are concerns from a compliance perspective.

This tells us that organizations need to look at the data domain from a more holistic perspective. This isn’t just the domain of marketers within the enterprise – anything involving data collection or capture has a GDPR element to it, which of course is primarily driven by compliance professionals.

That’s how I’ve felt for the past two years, especially being at home like all of us during the pandemic. I had nothing to do but write a new record and I could reach out to fans on the internet, but there was no real physical gig possible at that time, so Hate Uber Alles is like a reflection of the last five years.

The album assimilates different musical styles to metal, in particular Sofia Portanet singing on “Midnight Sun”. Why was it so important to create this contrast on this album?

The song was inspired by this movie Mesosome which came out a few years ago. There’s this really strong female lead that carries the story and I had a vision to incorporate that into our music. The lyrics are very inspired by this film.

I’ve known Sofia for a while and when we got together in the studio, it clicked. I wanted to make sure it really fits what we do. Unfortunately, in the past, we never really had a song where it would be appropriate to have a guest singer and Sofia. It looks like she’s part of the group and it’s really natural and unique.

Sometimes in metal it can be a bit cliche if the bands do a grumbling voice and all of a sudden [there’s] an opera singer that Celtic Frost cast at the time. We didn’t want that – we wanted to do something we hadn’t done before in order to have more variety on the record.

Growing up, opera was prevalent in your household. What influence does this emphasis and expressiveness still have on your own music?

I listen to all kinds of genres now and I don’t really think about [terms of] these categories. Either the music touches me or it doesn’t – I have to feel something when I listen to a certain music.

Opera and classical music have significant epic sounds and maybe it’s a kind of reflection on music and some songs.

Why are thrash bands so adept at maintaining a high level of skill so deep in their careers?

We always tried to justify the fact that we released another album after so many years. We could easily do like a best-of set and we could do four or five tours without playing the same setlist – we have about 140 songs.

Before going to the studio to make Hate Uber Alles. If you come up with a new record, it should have something unique and fresh about it. It should be something you’ve never done before, and of course it should be powerful. You have to maintain the energy and it has to be meaningful.
